Terms of Service

These Terms of Service govern the rights and obligations between LeaderMix ("Platform", "Service", "we") and any natural or legal person using the service ("User", "you"). By starting to use the Platform — by creating an account, signing in, or purchasing the service — you are deemed to have read, understood and accepted these terms.

1. Definitions

• Platform: the B2B lead discovery, e-mail discovery and digital marketing software offered at leadermix.app and dashboard.leadermix.app.
• Account: the user profile created via the registration form and authenticated with e-mail + password.
• Subscription: a paid usage commitment for a specific plan (1,000 Companies / 5,000 Companies / 10,000 Companies) and a specific period (30 days).
• Companies / AI text generations: 1,000, 5,000 or 10,000 companies; research up to 5 relevant people per company. AI is used only to write personalised emails or templates. New generations and rewrites use your text allowance; sending existing text does not.

2. Scope of the Service

LeaderMix is a cloud-based SaaS service offering Google Maps + AI-assisted B2B data collection, verified business e-mail extraction, LinkedIn profile delivery, AI-written personalised cold e-mails / general templates, automated follow-up and open tracking. The Platform requires no installation on your device and runs in a web browser.

• Company data collection, search with sector + region filters.
• Extraction of verified business e-mails and LinkedIn profiles (CEO, Founder, Manager, Sales, Export).
• AI-generated personalised e-mails and general templates.
• Automated reminder e-mails, open tracking, opt-out management.
• Telegram bot notifications, account reports.

3. Account Creation and Security

To create an account you must be at least 18 years old and provide accurate information. Each account belongs to a single natural or legal person; account sharing is prohibited.

• You are responsible for your password and for all activity performed through your account.
• If you notice unauthorised access, notify [email protected] immediately; if necessary we will temporarily suspend your account.
• Packages last 30 days. There is no automatic charge; renew by making a new payment.

4. User Obligations

By using the Platform you undertake to comply with the following rules:

• B2B communication only: bulk advertising / cold e-mailing to consumers (B2C) is prohibited. LeaderMix is designed exclusively for reaching commercial prospects.
• Turkish Law No. 6563: in sending commercial electronic messages, obtaining the required consents and managing complaints is the user's responsibility. Consent is mandatory for communication falling within the scope of İYS (the Turkish Commercial Message Management System).
• KVKK / GDPR: the legal basis of the personal data you collect and process is your responsibility. LeaderMix is the technical infrastructure providing the data; vis-à-vis the data subject, the data controller is you.
• No spam / phishing: misleading content, identity theft, and the distribution of viruses / malware are strictly prohibited.
• Data export: data retrieved from the Platform may be used only for the subscriber's own business processes; selling it to third parties or turning it into another data product is prohibited.
• Technical limits: reverse engineering the API, scraping with bots, or creating excessive load on the platform is prohibited.

5. Pricing, Payment and Renewal

Current plan prices are published on the pricing page and all prices include 20% Turkish VAT. The subscription fee is collected in advance at the beginning of the selected period (30 days).

• Term and renewal: subscriptions are fixed-term and do not auto-renew at the end of the period; no automatic charge is made to your card and your card is not stored. You are reminded by e-mail as the end date approaches; if you wish to continue, you renew yourself by making a new payment from the My Account menu or the plan page (Section 7).
• Payments are collected via the licensed payment institution Tami with 3D Secure; card details are not stored on LeaderMix servers and the payment is approved on your bank's 3D Secure page.
• Prices may be updated with at least 30 days' notice to your registered e-mail address before a new period; the old price remains valid until the end of the period already paid.
• If a payment fails, the account first switches to restricted mode; if no payment is made within 7 days, access to the service is suspended. Data is not deleted for 90 days.

6. Refunds and Right of Withdrawal

LeaderMix is a digital data-access platform offering company scanning, e-mail discovery and LinkedIn profiles. Once your account has been activated and any one of the following actions has been performed, you are deemed to have started benefiting from the service and no refund is made:

• Logging in to the dashboard and using any feature,
• Performing a single company search or e-mail query,
• Triggering an AI analysis call or starting an e-mail send,
• Exporting data as CSV / Excel.

The reason is as follows: data that has been delivered to, viewed by or retrieved by the user is digital content of an irreversible nature; once it has reached the user, it cannot technically be recovered through a refund or cancellation. In addition, LeaderMix pays per-query costs to third-party data providers (Google Places API, e-mail verification services, AI engines); these costs are non-refundable.

A refund may be considered only in the following exceptional cases:

• Payment was taken but the account could not be activated due to a technical error and this could not be fixed within 48 hours,
• The Platform remains completely inaccessible for 48 hours from the purchase date and no data / feature was used during that time.

For refund requests, contact [email protected] with your payment details. Requests are evaluated within 5 business days at the latest.

7. Subscription Term and Renewal

Subscriptions are fixed-term and do not auto-renew at the end of the period (Section 5) — no new charge is made to your card and your card is not stored. If you wish to continue using the service, after the reminders sent 5 / 3 / 1 days before your end date, you renew your subscription by making a new payment from the My Account menu or the plan page. If you do not renew, your access ends automatically at the end of the period; no separate cancellation step is required. All services remain active until the end of the current period. No refund is made for the period in use (Section 6 — right of withdrawal).

8. Intellectual Property

The LeaderMix platform, its design, source code, algorithms, trademarks and content belong to Hook Yaratıcı Reklam Ajansı ve Uluslararası Ticaret Ltd. Şti. and are protected by Turkish Law No. 5846 on Intellectual and Artistic Works and international intellectual-property regulations. You may use the Platform only for the purposes covered by your subscription; you may not copy it, create derivative works, reverse engineer it, or use the trademark or logo without permission.

Data uploaded to the platform by the user (e.g. CRM notes, tags) belongs to the user; LeaderMix accesses such data only to provide the service and within the scope of KVKK.

9. Service Warranty and Limitation of Liability

LeaderMix does not warrant that the platform will operate error-free or uninterrupted. Planned maintenance windows are announced at least 24 hours in advance. LeaderMix is not liable for outages originating from third-party providers (Google, Hetzner, Tami).

No liability is accepted for indirect, consequential or loss-of-profit damages that may arise from use of the Platform. LeaderMix's total legal liability is limited to the subscription fees you paid within the last 3 months.

11. Changes to the Agreement

These Terms of Service may be updated from time to time. Significant changes are notified to your registered e-mail address at least 15 days in advance. Continuing to use the platform after a change means you accept the new terms.

12. Governing Law and Jurisdiction

Turkish law applies to all disputes arising from this agreement. For applications made in the capacity of a consumer, the Turkish Consumer Arbitration Committees (within the monetary limits) and the Turkish Consumer Courts are competent. For disputes within a commercial relationship, the Istanbul (Anatolian) Courts and Enforcement Offices are competent. Mandatory consumer-protection provisions of your country of residence, where applicable, remain unaffected.
